Camouflaged motorbike for a e-scooter?

Isn't a scooter a motorcycle? We will all answer yes, but for others it is a no.

The Justice of the Peace of the Como Court, Barbara Capotosto, dismissed an appeal filed against 4 fines executed by the local police (the vigli urbani) to a young man who in 2021 was the victim of an accident while on his scooter, or at least of the vehicle he believed to be a scooter (and which it is). On the contrary, according to the traffic police , the vehicle had to be considered as a real moped, even if a moped goes faster than 20-25km/h.
